By accessing or using the CyperGlow website, mobile application, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our Services.

2. ACCOUNT REGISTRATION

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account

3. PRODUCTS AND PRICING

3.1 Product Information

  • We strive to provide accurate product descriptions and pricing
  • We reserve the right to modify prices without prior notice
  • Colors and images may vary due to monitor settings

3.2 Product Claims

  • Our products are cosmetic in nature and not intended to diagnose, treat, cure, or prevent any disease

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYPERGLOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

12. INDEMNIFICATION

You agree to indemnify and hold harmless CyperGlow, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your use of the Services or products
  • Your violation of any third-party rights

13. DISPUTE RESOLUTION

13.1 Governing Law and Jurisdiction

For United States Customers: These Terms are governed by the laws of Wyoming, USA, without regard to conflict of law principles.

For European Union Customers: These Terms are governed by the laws of the Netherlands and applicable EU consumer protection regulations.

For Other International Customers: These Terms are governed by the laws of the Netherlands.

13.2 BINDING ARBITRATION (US Customers Only)

PLEASE READ THIS SECTION CAREFULLY - IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS

  • Any dispute arising from these Terms or your use of the Services shall be resolved through binding individual arbitration
  • The arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
  • The arbitration shall take place in Wyoming, USA, or via telephone/video conference
  • The arbitrator's decision shall be final and binding
  • You may pursue claims in small claims court if they qualify
  • This arbitration agreement survives termination of these Terms

13.3 CLASS ACTION WAIVER (US Customers Only)

YOU AND CYPERGLOW AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

  • You may not participate in any class action lawsuit against us
  • You may not bring claims on behalf of others
  • You may not combine claims with other customers
  • The arbitrator may not consolidate multiple persons' claims

13.4 Opt-Out Right (US Customers Only)

You have the right to opt out of the Arbitration and Class Action Waiver provisions by:

  • Within 30 days of first accepting these Terms
  • Including your name, address, and clear statement of opt-out intent

13.5 EU Consumer Rights

For EU customers, nothing in these Terms affects your statutory rights as a consumer under EU law, including:

  • Your right to bring claims in your local courts
  • Protection under mandatory consumer protection laws
  • Your rights under the European Consumer Centre network

14. PRIVACY

Your use of our Services is subject to our Privacy Policy, which is incorporated by reference into these Terms.

15. SUBSCRIPTION SERVICES

If you subscribe to any recurring services:

  • You authorize recurring charges at the interval you select
  • You may cancel in accordance with our Subscription Policy
  • Refunds for subscriptions are subject to our refund policy

16. TERMINATION

  • We may terminate or suspend your access to the Services at any time for violation of these Terms
  • Upon termination, your right to use the Services will immediately cease
  • All provisions that by their nature should survive termination shall survive

17. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Changes will be effective when posted on our website. Your continued use of the Services after changes constitutes acceptance of the modified Terms.

18. SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

19. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and CyperGlow regarding the use of the Services.

21. SPECIFIC REGIONAL PROVISIONS

21.1 California Residents

California residents may have additional rights under the California Consumer Privacy Act (CCPA) and other California laws.

21.2 UK Customers

UK customers have rights under UK consumer protection laws, including the Consumer Rights Act 2015.

21.3 Australian Customers

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees under the Australian Consumer Law.

22. FORCE MAJEURE

We shall not be liable for any delay or failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemic, or labor disputes.

23. ELECTRONIC COMMUNICATIONS

By using the Services, you consent to receive electronic communications from us. These communications may include notices about your account and information concerning the Services.

24. ACCESSIBILITY
